Sale of a tractor trailer without a written agreement
I sold a tractor trailer to a friend for 13000.00 without a written agreement. A verbal argreement to pay monthly payments of $1000.00 a month. We have received $5000.00 and now they won't pay. I have a taped conversation of them agreeing to pay. I gave them the title in there name. How can I get my money and is the tape evidence in court? I want the truck or the money. What type of court would I have to go to. Thanks.

Since the balance which remains due is $10,000.00, you would sue them in a District court or Civil court (the maximum claim which can be filed in small claims court is $3,000.00). You would pick the District or Civil court located within the county in which the defendant lives, or does business, or the county in which he purchased the truck. As for the evidence which you would present in court, including the tape, it would be too difficult to explain the presentation of your case via a simple e-mail.
