There are too many variables and issues to consider regarding the structure of your business to provide generalized advice through this forum. I suggest that you contact an attorney who is familar with New York business law in order to discuss the best form of organization for you, whether that be a "C" or "S" corporation, LLC, sole proprietorship, or something else.
As for your second question, generally an ower cannot collect unemployment compensation.
I mostly agree with Brett. The major difference between setting up a corporation or an LLC is the cost. The LLC has a publication fee that makes it much more expensive.
Before you speak to a business attorney, speak to an accountant.
Mike.
I handle the entire process including the publication at perhaps the lowest price in NY. if you contact me via email or phone I can make help you make the decision very easily. No need for an accountant. Lastly, you should know that you generally cannot collect unemployment as an owner of a business.
