This depends on your specific business. You may need to collect sales tax. You may want the protective benefit of a corporation or LLC. You may want to trademark your business name. Your website may need certain legal disclaimers and/or terms of service. There are other things you may want to consider as well. It's hard to say without knowing more about the nature of the business.
