Yes acorp is separate legal entity yr status as on on felon or ex con does not keep u from forming one. The acts of the corp r separate from its incorporator or shareholder or officers. However remember that the incorporator of acorp is generally different person from the shareholders and officers; there are cos which advertise which will act as the incorporator and it is not too expensive (less than $300)

This can be done before release. Since you have computer access, you can do it yourself, through the Internet at the NY State web site. I suggest waiting until late December, indicating in your papers that the start date will be January 1, 2009. Since this is late in the year, annual costs do not make this worthwhile to do until January.
