Is there a statute of limitations on the payment of earned sales commission to the sales person that is entitled to such payment.

Six years. You may also want to read NY Labor Law sections 191-a, 191-b, and 191-c.

My colleague is correct. 6 years is the statute of limitation for such matters. Also be advised that under certain circumstances you may be entitled to attorney fees as a matter of law in cases involving sales commissions. So, if you have a dispute with your employer, you should consider retaining an attorney.
