Need to sue corp for breach of contract

I paid $10,000 to a corporation to send me a specified amt of web traffic. Not only has he not delievered this, he hasnot even advertised in the media we agreed. To get this traffic from somewhere else, I would have to pay $35K.

1) Can I sue him in District Court for the higher number of $35K so that I can still get the targetted internet traffic I wanted in the first place?

2) Assuming a breah has taken place, how much is it to get a lawsuit in District Court going by filing it, serving the corporation plaintiff...etc (please ballpark).

The limits in district court are $25,000.00 so you should sue in Supreme. The fees are the same.

Between filing fees and process server fees, you will probably be at $400-500.

Of course, this does not include any legal fees. Remeber, a corporation must appear by an attorney so to go it alone may be costly in many ways.

There is no District Court in NY.
