Legal Question in Business Law in New York
Suing a contractor
I was having a 2nd story addition to my house. My contractor has taken off with 90% of the money and is refusing to come back to finish the 50% left on the job. He wants more money for permit fees and architect fees which were included in the contract. Upon inspection of the job by the inspector he has done work not meeting codes and has out in cheap material and is jeopardizing my current housing structure. I have taken a home equity loan and my payment are due. I am in NY and he is in VT. Do I have a case?

Yes, it definitely sounds like you have a case, but in order to give you an unequivocal YES, I would have to review your contract.

Based on your statement of the facts, it certainly sounds like you have a case, but a definitive answer to that question lies in your contract; I would have to review it to say definitely yes or no.

Re: Suing a contractor
From the few facts supplied, it sounds like you have a good case. The biggest question now is: In which State does the contract set jurisdiction, Vermont or New York? That will determine where you can start your lawsuit.
Also, if the work was done in one of the five boroughs, you can file a complaint with the NYC Department of Consumer Affairs, which strictly monitors the work performed by home improvement contractors.
Hope this is helpful.
