Legal Question in Business Law in New York
Terminated and employer will not pay severance
I was recently terminated. The reason given was failure to meet sales quota. My contract called for 2 weeks severance for each year if I laid off or my position eliminated. No severance if terminated for cause. (There was definition of cause in the contract). The company is refusing to pay severance.
My position was not replaced, and the company had ''fired/laid off'' 3 other salespeople 45 days ago, and did not replace them.
A memo from the attorney the year before told me that I would receive the 2weeks/per based on ''involuntary termination.'' She gave this definition when we where changing the compensation plan payouts.

I would contact the NY Labor Department and file a complaint.
