Legal Question in Business Law in New York

Uh oh...Incorporated then realized I might need a permit

I incorporated just the other day. In my stupidity I assumed that incorporating means you have permission to do business and that you are basically licensed. Also I assumed that since the state has to approve it and you provide an address that if what your doing is illegal that they wouldn't incorporate you.

I want to run a home business out of my house. It will require no employees, customers, shipping companies, or anybody to come to my house so therefore it won't have any affect on my community. There won't be increased traffic etc etc. No one in the world will no I have a business. Do I need a permit or the state incorporating me is enough so I shouldn't worry?

If I am in the wrong and they find out what kind of penalities can I expect? It's not my fault they incorporated me.

You need an employee identification number for the corporation. The EIN number may be obtain from www.irs.gov.

Other than that, and depending on what you are selling, you do not need any permits.

Those questions depend on the type of business you are proposing. Some businesses require licenses or other types of regulations. Some have zoning concerns. For an in depth analysis of your needs it probably is worth your time to consult with an attorney who can assist you with your needs for your business, and it may be worth the while to hire an attorney on a retainer basis as it is always less expensive to hire an attorney at atime that you don't need one than waiting until you do.

Should you like to discuss this or any other legal matter, you can call my office to schedule an appointment for a consultation or in the alternative, I can be reached for on-phone low-cost legal consultation at 1-800-275-5336 x0233699.
