Can I have someone who is undocumented with ITIN as a partner to form LLC?

I don't recall seeing anything on the paperwork which has to be filed to form an LLC partnership which asks for someone's legal status as a US or New York resident. That's a good question. You may have problems somewhere down the road, but to get the company up and running you'll probably be okay.

Generally speaking, for most companies, one does not have to be documented to own a company in the US. However, an undocumented person cannot work in the US even for their own company.
