Legal Question in Business Law in New York

Unjust Enrichment

I have a client who contracted me to design a website for her. We signed an agreement stating that a non-refundable deposit of $1500 be paid in order to cover initial costs of the design which she paid. The remaining $1500 would be paid upon completion. However, after several hours of work and after months of confusion and disagreement, I opted to discontinue my involvement with her project. She is a lawyer and claims that it would be Unjust Enrichment for me to not refund her money even though I feel that I have done more than $1500 worth of work for your, some work even being beyond the scope of the contract. Is she correct or is she just using her legal expertise to bully me around? What are my rights in the matter? Thank you for your time.

Re: Unjust Enrichment

if you can show and justify $1500 worth of work then you do not need to pay back the deposit, but if the deposited was phrased as to "cover initial costs" you have to show the costs to justify keeping it.

Should you like to discuss this or any other legal matter, you can e-mail me for more information about low cost face-to-face, on-line, or a telephone consultation with a lawyer in our office.
