Legal Question in Business Law in New York

verbal contract

Three people entered into a verbal contract,one person in one party and two in the other party. The one person asked the other two to meet two conditions. Both conditions were met that day, but the following day one person in the party of two party decided he wanted out and asked for his property back, it was given back. How does this leave the contract?

Under classical contract law, the contract is in material breach.

Under modern contract law, the contract may be in material breach, but the breach may be curable if the remaining parties wish to continue to execute the contract.
