Regarding wholly owned subsidiary & parent company
If an employee works for a parent company and while ''on the job'' is injured while working in an area that is owned and operated by the subsidiery company, can that employee collect workers compensation from the parent company and also sue the subsidiery company in a third party suit?

Probably. They are different companies.

I take that back. Why os the parent paying workers' comp if the injury occurred at the sub?
Re: Regarding wholly owned subsidiary & parent company
Yes, of course.
Wouldn't the parent company, if the subsidiary got sued claim that they were exempt because the companies are separate and distinct? When it works to its detriment the parent can't then turn around and say the companies are in actuality one employer.
