Legal Question in Civil Rights Law in New York
Attorney Malpractice
I filed a small claims case against my lawyer and he responded with a Notice of Motion to Dismiss and pursuant to CPLR 2214 (b), answering affidavits to be submitted in 7 days, and an Affidavit in Support. Firstly, how do I go about representing myself and am I legallly responsible to answer before our court date?

Re: Attorney Malpractice
It would be prudent to look to retain an attorney if your have a claim worth prosecuting. In regard to the motion and the requirement to answer, your answer is yes you are responsible to answer before the court date.
For more information regarding the motion, you can find answers relating to CPLR 2214 by Googling it.
Good Luck.
