Legal Question in Civil Rights Law in New York

ATV Accident Liability

Is there a contract we can make to prevent someone from sueing us if they were hurt riding an ATV on our property? Something that says, they can ride but we are not responsible for what happens?? What would I need to do? Thanks!!

Re: ATV Accident Liability

You can use a standard assumption at risk clause and that the customer agrees to hold you harmless for any negligence or negligent acts which occur while on your property but you have to understand that such clauses do not always uphold judicial scrutiny. Additionally you cannot indemnify yourself against a minor and a parent cannot disclaim the rights of his child.

Should you like to discuss this or any other legal matter, you can call my office to schedule an appointment for a consultation or in the alternative, I can be reached for on-phone low-cost legal consultation at 1-800-275-5336 x0233699.
