Legal Question in Civil Rights Law in New York
car and motorcycle accident
My son was using my BMW to go to work on 9/3/06 at approx 800pm. there was a black out situation in yonkers ny on that night. As he was traveling north he saw his friends ooutside of there house and decided to stop for a while. there had been traffic due to the balckout but saw that it was clear to make a left hand turn . he saw 1motorcycle pass and then another. since it appeared to be clear fo any vehicles he proceded making the left. when as he was 3/4 into the turn he gets blasted by another motorcycle sending that driver 30 ft over the car. this driver has NO motorcycle license or permit for the cycle nor did he own it but insured by another person. now he is sueing me for damages and personal injury. can i counter suit him or what can i do in this situation. please help. thanks

You must inform your insurance company asap. Send them the papers immediately.They will defend the lawsuit and decide that type of question.

You may have a countersuit against this person, however you should inform your insurance company that yo uare being sued so they can take the case over. Usually, if you're being sued in this type of situation many people get frightened and dont know what to do next. Sending the information to your insurance is usually enough, and they take care of all of the rest - so get them the information on the lawsuit as soon as possible.
