Legal Question in Civil Rights Law in New York
Name Change of a Child
My daughter is 2 years old. Her father and I are not married and at the time of her birth, the hospital told us that the birth certificate should have my last name on it. So, on the document our child had my last name even though he and I wanted her to have his. Still at this time we are not married and would like to have our daughter's last name to be changed to his. Paternity was established and we do not know where to go from here to get her last name changed. Also we heard going to court on name changing is tough and wondered also would we have the favor of the court.
