Legal Question in Civil Rights Law in New York

Name Change

I have a three year old son. I married my husband two months after he was born and we are now working to change my son's last name to my husbands. I have had no contact with the ''father'' of my son since before I found out I was pregnant. Do I have to try to find him for notification of this action? He has had no involment what-so-ever in my son's live. Thank you for your help.

Re: Name Change

The parental rights of the biological father must be terminated before the child is eligible for adoption. This is true regardless of what contact there may or may not have been.

To do otherwise is asking for potential disaster in future years, as the adoption will be void and the biological father may come back in time and claim his child.

See an adoption lawyer in your town and do it correctly. You will be glad you did.
