Legal Question in Civil Rights Law in New York

Civil Rights Law Section 51 My Name Has Been Used

My stage name and full color picture has been used on postcards to promote an upcoming event at a local nightclub. It states I am to attend and perform at this location. Not only do I not know the people organizing the event, I found out from finding a flyer in the street. What legal actions can I take? Can I prevent the club from opening? Can I sue? If so who or how do I find out who the people are? The party is for all ages so I am guessing it is young kids who did this (16-21). I am well known. Thanks.

It is blatantly illegal to use your name or image for commercial benefit without your consent. You can send them a cease and desist letter. You can sue for damages.

Should you like to discuss this or any other legal matter, you can e-mail me for more information about low cost face-to-face, on-line, or a telephone consultation with a lawyer in our office.
