Legal Question in Civil Rights Law in New York

Defamation of Charactor

I had a criminal matter against me...I had wrote a check for a friend who was suppose to give me the money for their rent and they never did, so I stopped payment on the check...the next thing I know there is a warrant out for my arrest for issuing a bad check, when I went before the Judge for my arraingment, he ROR it because the check clearly stated, stop payment, not insuffient funds, the charges (after one year) are finally being dismissed and I was wondering if I could sue the landlord who the check was written to. Thank you.

Re: Defamation of Charactor

For what, trying to collect on a check you wrote to him and that he tried to cash? You got lucky. The judge was wrong on the law. Dismissal was not called for. Sure it is a harder case to prove but he should have let them prove it.

You did a stupid if not a criminal thing. You then cost the landlord precious time in evicting your no good friend. Sorry but I don't think there is an attorney dumb enough to take this case without you paying him so much that it would not be worth it.

Next time, don't write a check you can't or won't cash. Truth is an absolute defense to defamation. You uttered a bad check. The truth is the landlord did nothing wrong.
