Disabled person is denied reasonable accommodation on a bus.

I have a Traumatic Brain Injury, as well as anxiety, depression and sleep disorder. I use a cane to ambulate because I frequently have trouble with balance and disorientation. I have been certified as disabled. In July, I asked the bus driver to extend the whhelchair lift on the bus. he refused to do so saying it was reserved strictly for wheelchair users.

About two weeks ago, another driver refused to extend the lift on the bus. Instead he exclaimed: ''Get on the bus, man. In both cases I boarded the bus, because I had not choice. Do I have a case?

I believe you have a claim, but here's the problem. For any claims against any municipality in NY, you have to file a notice of claim within 90 days of the incident. You are probably too late on the July incident, but should be able to file the notice of claim on the more recent incident. You should contact an attorney to help you file this paperwork.
