Legal Question in Civil Rights Law in New York

Dog issues

Last Thursday our pitbul attacked another dog. our 4 year old was going outside and accidently let her out. the other dog had no injuries my husband and the owner looked over the dog. The dog warden came and did not issue any citations. Today they called and said the other dog developed a neck problem at 3:00am this morning and was rushed to the emergency vet. The dog control then stated that they were issuing a citation and the owner was going to sue us. Also the dog control warned us that the judge was not happy and was most likely going to order removal of the dog. Should we obtain a lawyer? We are supposable being served with court papers tonight. Please advise us on how what steps we should take. This is our dogs first offense and nothing like this has happend before

Overall, the major issue is whether your dog had any previous citations... this may be defendable dependng on the facts... especially under the circumstances you provided.
