Legal Question in Civil Rights Law in New York
HIPAA/Privacy
About five years ago i received psych. counseling. For some time i was being billed for copays. Now a collection agency has filed a judgment with the court for the copays. What bothers me is that the provider of services disclosed to the collection agency procedure codes as well as diagnosis codes. I feel my privacy has really suffered. What can i do?

Re: HIPAA/Privacy
Generally, one of the issues with billing is that there has been some leeway with regards to revealing of inforomation which may have otherwise been recognized as privae, for the purposes of billing. It happens in the legal profession, as well as in the medical profession.
That being said, the revelation of diagnosis codes could legally be seen as having gone overboard, and violative of HIPAA.

Re: HIPAA/Privacy
Short of seeing an attorney, I would suggest that you visit the website for the U.S. Dept. of Health and Human Services (www.hhs.gov) and go to the page on HIPPA. However, from your e-mail it appears that there has been some violation of HIPPA (revealing diagnosis codes).
