Legal Question in Civil Rights Law in New York
I join a Resort/travel agency one year ago. When I went to use the Travel Agency to book a trip (they have membership with condos/apt/ time share across US) it took well over 6 weeks for a response causing my family to cancel our plans. I contacted the local RV resort (where my membership generated) and no one would return my calls. The actual sales person resigned/quit within weeks of my membership but gave me a "phone number" to call for more information but to no avail. After several attempts to get someone to help me I decided I no longer wish to have this membership. I filed a complaint with the BBB of NYS but after months they could not reach anyone at the resort to solve this problem. They suggested I file with the Attorney General's Office, which I did. Recently I received a letter from them indicating they were unsuccessful in their attempts to reach someone as well at the resort. My question is do I have a good case against them to file in small claims (for $930) the cost of my membership and court fees. Should I get a lawyer to represent me as well. You appear to have a good case but not a good case for collecting the funds. You can see if these indiv are opening under difft corporation names and go after the new corp and the same old people-sometimes it works; I do it with pet stores opening under new names to avoid previous liabilities, in my cases, selling sick pets then trying not to reimburse vics as required by law (and they have lots of others coming after them as well including the AG). The lawyers I know cost far more than $930-SCC usually requires 2 Appearances, sometimes more, prep time for court...
I wish I had a better answer.
