Legal Question in Civil Rights Law in New York
Is it legal to ask for divorce papers as a condition of employment at a hospital as a Physician Assistant. I have met the requirements for the DEA and NYS Dept. of Health, NCCPA, etc in changing my name in 2007. I have been married two times before. The CEO at the hospital would not sign off on my credentialing unless I provided my divorce papers and would not give it to me in writing and I am without employment as a result of this. I provided all usual and customary documentation as required for credentialing. I have never had any issues ever with employment or malpractice and have excellent references. My husband is a Physician Assistant married just as many times and was accepted for hire at the same facility and did not take the job as a result of the above. I was also accused of "hiding something" which could not be further from the truth.

This sounds like a case of unlawful discrimination under Title VII (sex discrimination (gender)). This is unique to women (the name change as a result of divorce). I am reasonable sure he would not make the same request to a a man. You may want to consider filing a claim after speaking with an employment law attorney.
