Legal Question in Civil Rights Law in New York

Noisy neighbor

Hi, my neighbor downstairs has been

noisy since I moved upstairs of him

(almost 4 years now). I have let him

now that his TV and music are too

loud especially at night but he simply

doesn't care. We went through many

arguments, police calls, I event took

him to arbitration. He finally decided

to give me his phone number for me

to call him if he is too noisy. Now if I

call him he tell the police I am

harassing him.

He now has a new electric noise

coming from bellow my bedroom that

keeps me and my husband up all

night.

The landlord doesn't seem to do

anything about it and gives him all

the rights to do anything he wants in

his rental apartment. I own mine.

What can I do? May I sue him?

I feel completely hopeless. I know

that what he is doing is not right, we

should not be deprived of our nights

of sleep. His parents are the lesses

but they don't live here most of the

time.

Can you help?

You certainly have rights to quiet enjoyment of your home. Police won't help then it is back to court. This time however use an attorney and if you used one last time, use a different one who will force the landlord to act against this foolish person.
