Legal Question in Civil Rights Law in New York

Nude pics

is it against the law to take a full nude picture in public in front of a histortic area, such as yankee stadium and then have that picture put on the internet as publicity. the picture says project red socks, on it and the photographer admits to taking the picture on the highway in front of the stadium as sort of a joke to the yankees. it is for aids awareness according to the photographer, but the picture states nothing about it. it is completley nude showing all of the female body parts. what is the rule on artistic art or obsenity. doesnt that break new york penal code 245.01. thank you for your help

245.01 is more than likely unconstitutional but Yankee stadium is not a historic building and even if it was, the historic location wouldn't be a dispositive fact anyway.
