The short answer to your first question is, because New York has not weighed and adopted a public policy that accepts the idea of "political discrimination". If you think this is an important issue you should contact your state senator and assembly member. To answer your second question there might be instances when someone's First Amendment rights or other rights might be violated because the entity --especially in a public employment setting -- might be politically singled out. These types of cases that moved forward on similar theory have somtimes been unsucessful, like one recently in Long Island(2005). Generally, cases involving discrimination (under state law) and/or violations of state and federal constitutional rights ultimately turn on facts. So the answer to your second question is, there might be.
