Legal Question in Civil Rights Law in New York

payment awarded after property damaged

If I received an award for the full value of my leather coat in small claims for damage by a tailor, do I legally have to give up the coat? His lawyer will not give me the check until I give him the coat. The judgement did not say anything about giving up the coat. It is my property and he did not buy it from me, he paid for damage he caused. If I damaged his car and paid for the damage, I wouldn't get his car.

Re: payment awarded after property damaged

If the judgment was for money damages and there was no stipulation that in return for the damage awrad you were required to return the coat, then you are entitled to the money damages and to retain the coat. If the other party refuses to pay the award there are procedures to find the party in contempt of Court for failing to satisfy the judgment.
