Legal Question in Civil Rights Law in New York

Spare Time

Hello I am having a situation at work and I was wondering if you could give me some guidance. I was complaining about my job on a blog on myspace. I never mentioned where I work or the specific people I was talking about. It was just a normal everyday rant. Upon my return to work my manger asked me if I had posted a comment on myspace about hating my job. Is this legal? She continued to say that she doesnt care what I do in my spare time but if it affects the work place. Is it not my right to voice my opinion especially since I did not mention where I work or the people I was talking about. I understand that myspace is something that everyone can read. I do have my profile set to private so that only my friends can access my page. Needless to say my manager is not on the list of people who can view my account. The following information is hear say from a reliable source. A coworker had stated that my other co worker that I suspect gave this information to my manager had left the internet page for myspace open and my manager just happened to click on my page and just happened to find my blog. Does my manager or company have any right to approach me at work about what I say in my free time?

If you could give me some guida

Re: Spare Time

From your question it appears that you accessed myspace through the use of your company's computer and your company's internet connection. With that being the case, management has the right to "police" and even deny personal use of company equipment. My suggestion is that you change your password and remove your co-workers from your myspace friends list.
