Legal Question in Civil Rights Law in New York
Can you sue for pain and suffering in small claims court (state of NY)? I am preparing a case against my daughter's school. Should the defendant be the actual school, or the school district?

I believe you can, but your damages will be limited to the small claims jurisdictional limit. Depending which small claims court you are thinking about, that could be $5,000 or $15,000.
There is no benefit that I can think of to such a course of action.
