Re: surveillance camras
Not in an area where people have a reasonable expectation of privacy (where they are getting undressed).
Should you like to discuss this or any other legal matter, you can call my office to schedule an appointment for a consultation or in the alternative, I can be reached for on-phone low-cost legal consultation at 1-800-275-5336 x0233699.
Re: surveillance camras
This is not really my area but as I understand it, it really depends.
The recent enactment of "Stephanie's Law" exempts a business from criminal liability if certain conditions are met such as posting a conspicuous notice or having the cameras in an obvious location and, of course, having a legitimate purpose such as theft reduction or security. However, even with those "exemptions" in place, if someone then takes those tapes and sells them, displays them to others or even uses them in their own private moments for their own enjoyment, they would be subject to penalties.
For additional information, you can see the actual statute here (particularly, Section 250.65): http://assembly.state.ny.us/leg/?cl=82&a=62
Hope this helps.
