Legal Question in Civil Rights Law in New York

vacated default judgement

We are suing a contractor who owes us $25,000.00 from 2 years already. our atty. got us a default judgement against him last year-his bank accounts are closed bu company is still active status. contractor's atty. got the default judgement vacated due to the fact he was unaware that his 1st atty. did not settle with us (whatever)-he has not filed an answer and it is way over 20 days. our atty. claims this case is a dead issue because contractor's atty said he will be filing bankruptcy and we will never see our money. what do we do now? is there any way we can collect what is due us? we already spent over $5,000.00 we didn't have on our atty. who seems to be giving up. please advise.

There may be other remedies available to you, depending on whether the contractor was licensed at the time he performed the work.

The attorney might be giving up because pursuing a claim through bankruptcy will probably cost you more than the case is worth.
