Companies scaning your computer for 3rd party programs

While playing a video game, is a company allowed to scan your computer in order to make sure you are following their ToS. A company that makes video games is allegedly scanning computers for third-party programs that violate their Terms of Service. Is this allowed? Also, if their ToS says they are allowed to scan your computer, how much of your computer are they actually allowed to scan?

The ToS governs. If you agree to it you have agreed to it. Now, at some level a shrink-wrap ToS or license is a contract of adhesion and the more onerous aspects may not be enforceable . . . but that's a question for a judge. If you are truly incensed I'd like to hear about it. My colleagues and I are active in this area.
