Legal Question in Technology Law in New York

My email was hacked and used for commercial advertisments...what can I do?

I am an AOl user and this morning when I could not access my email, I was told that my passwords were invalid. When I called AOl, I doscovered that someone had hacked into my email and used it to send out dozens of emails promoting an extreme porn website and a debt consolidation service. Not only was my email broken into, but used to send advertisements for sites I personally consider offensive. It seems to me that this should be illegal. Can I sue them? Can I have them arrested? What are my options?

The hacking into your AOL account is actionable against the perpetrators, if you can find them. The reputational damage you suffered from the perpetrator's sending of emails adds to the value of your case (damage-wise). The actions may also be criminal, and you might want to contact the D.A.'s office.
