Legal Question in Technology Law in New York

Internet naming dispute

Recently I registered a website for a business plan I was working on. However, when I checked a number of search engines to see what a search of my business name would bring up, I realized that someone has used my name for a business plan of their own even though I have registered the web address. Would my continuing to use this name leave me open to future litigation? Is there a way I can register this name to indemnify me from future legal action? The second party has no contact info listed on their search results, how do I remove these search entries without opening myself up to legal attack in the future?

Re: Internet naming dispute

Your statement of the facts is unclear, but I think you are saying you obtained a domain name and now find from a search engine that someone is using the same term as their trademark. There is a possibility you could be infringing, depending on the specific facts. Call and we can discuss this further and, if still possible, assist you to take the steps you need to protect your position.
