Legal Question in Constitutional Law in New York

Arainment

My son was arested for running across the field after a professional baseball game was over. He has been in jail for 36 hours without seeing a judge. I thought his rights were being violated if he is not seen in 24 hours. What are his rights in due process?

Re: Arainment

GENERLALY, the rule is only twenty four hours... however, if the system is overly packed or if there is any other reason for corrections to running behind - in some courts it is rare to ever get anyone seen in front of the judge within the 24 hours.

Also, if you are permitting legal aid to handle the case there is a tendency to take longer, since you have ot wait on them... if you're interested in consulting me further regarding this case, or any other matter, please feel free to contact my office at 2127098303
