Legal Question in Constitutional Law in New York

Is it illegal to take pictures of random people on the street and put them on the web? For example , a picture of a woman walking down street. The pictues would simply be put on webpage w/ a comment of how beautiful she is, nothing pornographic nor hurtful.

Generally in order to use anyones image you must obtain prior written release, otherwise if they find the image and decide to file suit against you then you may be liable.
