Legal Question in Constitutional Law in New York
I own a piece of property that was signed over to me by my father. At one time, a section of that property was taken to build a Federal missle site. The Missle site has been closed and the property taken over by the town as a town garage. They are now in the process of wanting to expand, to a town hall, police headquarters, ect. My question is, ..at the time of the missle site, the government, only owned a right of way across the property.. can the town open it up for public use?.. Does that not take away the rights of the land owner?

Yes, the town can take your land for public use under "eminent domain;" however, you must be compensated for the taking. An attorney's advice and counsel is where you should begin. The attorney will file suit or negotiate on your behalf for a monetary compensation based on the value of your property.
