Legal Question in Constitutional Law in New York

Plea bargain agreement

I am trying to obtain a copy of the plea bargain agreement my son signed. He is a mental health patient with the mind of a 13 year old and is serving the same sentence the other (repeat) offender is serving and my son believes they based it on probation violation. (he has never been in trouble with the law before.) His lawyer never met with him until sentencing or returned calls and when I try to talk to him, he yells at me and gets defensive. There's no dispute that my son broke the law, but we never got one stitch of court documentation. How do I go about communicating with the lawyers and obtaining any legal document that may help my son?

Re: Plea bargain agreement

you may get copy of thi through the attorney, or you may go to the clerks office and request a copy from the court... this may not be permitted depending on the court the case was heard in but theres no harm in trying and it would definitely get you out of having to talk to the previous attorney. you may consider attempting to appeal his sentence.

Re: Plea bargain agreement

The attorney's behavior is dispicable assuming you are being polite and not accusitorial.

Call the attorney again, explain what you want, there may not be a written plea bargain it may have been an oral on the record consent, then if he is rude explain that if he continues to treat you that way you will file a complaint with the grievence committee and hire a lawyer.

Good Luck
