Legal Question in Construction Law in New York

Bathroom remodeling

I have a contract with a construction company to remodel two bathrroms. One is 75%finished the other hasnt been started. The people feel that they shoul be paid in full for the fiest bathrrom whereas the contract clearly states 50%down remainder when the job is finished to the customers satisfaction, which has not happened. They were suppose to come to finish and did not show up and I havent heard from them since. what should I do??

Re: Bathroom remodeling

First, you have to send notice demanding compliance with the contract.

Second, if after notice company fails to perform under contract, you would send another notice terminating the contract.

Third, you would then retain another company to complete the job. You may hold the defaulting company responsible for any price overrun.

Finally, you have the option of filing a complaint with the Department of Consumer Affairs, or any other department that oversees home improvement contracts.

Re: Bathroom remodeling

Hire a new contractor to finish the job, but only after you get a copy of the permits (plumbing and electrical) for the job. You have a bad contractor. Don't make it worse. At least you're only out the 25% you overpaid toward the not-started bathroom.

You could sue the contractor, but that won't get the bathrooms finished.
