Legal Question in Construction Law in New York

Builder required to provide C of O?

Bought a home (nearly 2 years ago) built by NYC Builder/Contractor that only had a temporary CO. Is the builder required to obtain/provide a permanent CO?

Re: Builder required to provide C of O?

Well more importantly in the first instance..how did your lender and your title company accept it with only a temporary c/o?

You can buy anything that you want sooo..was there financing? how do you know there's only a temporary now?

More info is needed. Feel free to write back.

Good Luck

Re: Builder required to provide C of O?

It depends on the language of the purchase agreement.

I have seen circumstances where a sale would occur with a temporary C/O. However, there is usually a provision directing the builder to obtain a permanent C/O after a specific time or condition.

I would speak to the lawyer that handled your purchase.

Mike.
