Building code violations
Business decide to chage the face of the building no permit was in place at start. Owner is requesting an employee appear in court on his behalf. Can this happen?

I'm not exactly sure what you're asking. However, if the business is a corporation or LLC, the business must appear with an attorney at the Department of Buildings.
If the business is not incorporated, such as a sole proprietorship or general partnership, one of the owners must appear.
If an employee goes to court, the judge will generally allow the employee to simply request an adjournment to another date when the owner is available.
