Legal Question in Construction Law in New York
Cancel contract and return of my deposit
Contractor cashed deposit check instead of putting it into escrow account as required by New York State law. He does not return my phone calls. Deposit was given on 9/24/07 for new sidewalk in front of commercial building Job was never started. Who do I contact to resolve this breach of contract? Thank you

You should send a letter to the contractor demanding performance by a date certain or return of the money. After the date certain, if he still does not perform, retain another contractor to fix the sidewalk and commence an action against the contractor for damages.
