Legal Question in Construction Law in New York

When is the contract void

I need to know what makes a contractors contract void ? If a person who is not a officer or an agent of the corporation signs the contract as a contractor when he knows he also does not have a license to sell you these services and he has no legal power to do so ? Does that make the contract void?

Re: When is the contract void

Academic questions are hard to answer. This sounds like you had work done and you want to avoid paying for it. You might succeed in showing thsat the contract is void. The contractor can still file a mechanic's lien and sue you for what the work is worth...which could be far more than you agreed to pay in the first place. That is especially true if you got a lowball price from an unlicensed contractor. So the word from here is to treat the contractor as you would wish anyone else to treat you, because there ain't no free lunch. YOU may end up as the main course.
