Legal Question in Construction Law in New York
Id hate to go to jail
A previously asked question almost answered my question but it didn't give enough details so I want to add more to that persons question about the bank account. I am having a similar problem because I did not anticipate that banks would ask more of a corporate account then of a personal account(I thought it would be similar). Anyway if I accepted payments in the form of cash or money order or a check to the corporation before an account was set up but used that money to open the account would this be a problem? Is it legal to accept a check before there is an account for it to go into? I wouldn't cash the check or money order until the corporate account is started, which would be started with that money. Is this legal?

Re: Id hate to go to jail
Yes, it's legal. There might be a problem (civil, not criminal) if the corporation did not exist. On these bare facts, there does not seem to be criminal exposure, though if this is part of some money-laundering scheme or other illegal artifice, criminal exposure is a possibility.
This post is not legal advice and does not create an attorney-client relationship. It is a comment on the legal question posed by the poster and should not be relied upon unless and until an attorney-client relationship is entered into. Doing so would require signing an engagement letter and depositing a retainer to secure payment of legal fees.
