Legal Question in Construction Law in New York
House falling apart
Back in 2005 we hired a company to
do restoration work on our home
after a house fire. This company
hired another company to do the
work yet we only paid the first
company. We never signed a
completion of satisfaction because
they never completed the job. Our
siding is bubbling, walls are cracking,
kitchen floor is bubbling, nails coming
out of wall, garage door is not aligned
correctly, garage roof leaking, leak in
living room, central air leaking, and
gutters not installed correctly. These
are our major issues plus there are
other issues. We did hire a home
inspector which supports out claim.
What legal recourse do we have? We
do not want them back on our
property doing any work. Also the
sub contractor did not get a license
till after he gave the estimate and
begun work. This we found out after
they were more than 3/4 of the way
finished. We were told by our
adjuster that it was okay because
they were working under the
companys license we hired.

YOU sue the adjuster and the company you hired as well as the subcontractor. You may also sue the individuals outside of their corporate personality if the facts are available.

One thing that the adjuster was right about, is that the sub is usually covered under the prime contractor's license.
