Legal Question in Construction Law in New York

Land question.

There are 4 houses on one land. Each house is owned by an indiviual owner. The backyard does not have fences to cut in between to mark the amount of land each house can have as a backyard. So is it legal to decide for yourself how much of the land in the backyard you can have and use for yourself?

No, it is not. The nature of real estate is such that (except for Antarctica) there is no part of the earth as to which no-one is "in title." Somebody is the legal owner of the land. Somewhere there is a deed that identifies where the boundary is. You need to find the governing deeds, and that will conclude the issue unless there are exceptional circumstances involved.
