Legal Question in Construction Law in New York

Regarding the NYS Wick's Law, can the Contractor for General Construction, on a state project with separate primes and a construction manager, be required to develop an integrated project schedule and held responsuble for weekly updates and revisions to keep project on schedule?

You betch'a he can. The CM is usually responsible for coordination, scheduling, etc., ESPECIALLY on these big mixed-use structures that are so fashionable work. It's specialized work both from the CM's perspective and that of the team that produces the Contract Documents. The Contractor for General Construction is the fulcum on which the whole project will revolve. You want to make sure your team includes a consultant who knows the players as SCA and DASNY (and sometimes others like the SUNY Construction Fund, NYC Educational Construction Fund and the like). THere's a lot of negotiating to do over making sure that the GC can control the Wick's trades. (Yes, it can be done, it has been done, I have done it.) Feel free to call 516-242-1453.
