Your question does not have a simple yes or no answer. For example, is there insurance covering the backhoe? If so, have you notified your carrier in a timely fashion? What do you mean by a "violation"? Are you referring to a criminal violation or an Administrative violation? Have you seen the estimate? Have you seen the damage? Perhaps the Utility Company is overcharging you. Are you absolutely certain that your company is 100% at fault. Perhaps the utility company failed to notify you of the existence of a water main.
Contact an attorney; most will be able to answer these questions with a simple phone call.
I wish I could give you a more dispositive answer. Best of luck.
